Texas Suspends Data Center Stormwater Approvals

At least 17 authorizations have been suspended, according to Public Citizen, as TCEQ adds staff review to applications linked to data center construction.
The Texas Commission on Environmental Quality has suspended construction stormwater authorizations associated with data center projects following scrutiny of approvals processed after Governor Greg Abbott’s September 21 permitting pause.
Public Citizen reported at least 17 suspensions on October 22. TCEQ confirmed suspending identified authorizations but disputed claims that it violated the governor’s directive.
Reported cases include authorizations covering approximately 700 acres in Hudspeth County, 450 acres in Taylor County and a Sitespan development between San Antonio and Seguin. The approvals cover stormwater runoff associated with construction activities, including clearing, grading and excavation.
TCEQ also temporarily disabled automated processing through STEERS. Applications must be physically submitted so staff can determine whether they relate to data centers.
The suspensions could affect site preparation while Texas reviews data center electricity and water requirements. They do not establish project cancellations, with construction impacts dependent on each site’s authorization status.
