Texas Data Center Permit Reviews Remain Under Scrutiny

Further reporting examines air-permit activity following TCEQ’s suspension of data-center-related stormwater authorizations.

Texas’ data center permitting pause remains under scrutiny as watchdog groups question regulatory activity beyond the stormwater authorizations suspended last week.

An October 26 report revisits TCEQ’s compliance explanation to the governor. The agency maintained that it had not issued permits for data centers or directly supporting infrastructure, while FracTracker and Public Citizen challenged other actions taken after the September 21 directive.

The dispute includes air-emission certifications, public notices and reviews of proposed gas-generation equipment. Seven emission-limit certifications identified by the investigation still appeared as issued in agency records.

TCEQ has suspended identified data-center-related stormwater Notices of Intent and disabled automated processing for additional screening. The latest reporting concerns the scope of the pause, rather than a newly announced batch of suspensions.
