A newly reported wrongful-death lawsuit concerns the death of a contractor’s employee during construction at Starbase in May.

The family of Jose Luis Bautista Jr. has filed a wrongful-death lawsuit against SpaceX following his death during construction at Starbase on May 15.

Bautista worked for Delta Fabrication & Machine, a contractor involved in construction of the Gigabay rocket-manufacturing facility.

The lawsuit alleges that an inadequately secured steel beam tipped during the work, causing the fatal incident. The family alleges negligence and gross negligence; those claims have not been established as judicial findings.

OSHA’s investigation is ongoing, with findings expected in November.

The October 28 report brings the legal proceedings into focus several months after the incident. It represents a new stage in the investigation and litigation surrounding the construction fatality, rather than a new accident or a new project award.
